Termination when moving in Switzerland: When does a special right of termination apply?

A move brings not only moving boxes and address changes, but also raises legal questions about ongoing contracts: Can I terminate my internet contract early if there is no coverage at the new address? What happens to home contents insurance when two households merge? And how do you terminate the tenancy agreement in a legally watertight way?

In this guide, you will learn when Swiss law grants an extraordinary right of termination, which deadlines you need to observe and how to avoid costly double payments.

1. Terminating the tenancy agreement: formal requirements and finding a replacement tenant

Terminating the flat is the heart of every move. Strict rules apply under the Swiss Code of Obligations (OR).

Ordinary termination (OR 266a et seq.)

  • Notice period: For residential premises, the statutory minimum notice period is 3 months to a locally customary termination date (often end of March, end of June, end of September or monthly except December – depending on canton/tenancy agreement).
  • Written form: The termination must be in writing.
  • Multiple parties / married couples (OR 266m): If it is a family home or a joint tenancy agreement, both spouses or all tenants listed in the contract must sign by hand. If a signature is missing, the termination is void!

Early return / providing a replacement tenant (OR 264) If you wish to move out outside the contractual deadlines, you are only released from your financial obligations if you propose to the landlord at least one reasonable and solvent replacement tenant who is willing to take over the tenancy agreement on the same terms.

2. Internet, TV & landline: extraordinary termination when changing location

A frequent point of dispute when moving concerns subscriptions for internet and TV (e.g. Swisscom, Sunrise, Salt).

  • Product available at the new address: If you move to a place where the provider can deliver the same service, the contract continues for the agreed minimum contract term. The contract is activated at the new address.
  • No service at the new address (special right of termination): If the provider is technically unable to deliver the contractually owed service at the new address (e.g. no fibre-optic connection or lack of network coverage), this constitutes what is known as impossibility of performance. In this case, you have the right to an extraordinary termination effective as of the moving date.

3. Household contents & liability insurance: avoiding double insurance

When two people move together into a shared flat, double insurance cover often arises.

  • Moving in together (two policies collide): If two households are merged, the younger of the two household contents insurance policies can generally be terminated extraordinarily as of the moving date. It is enough to submit confirmation of the merged residence to the insurer.
  • Moving abroad: Anyone who permanently leaves Switzerland and relocates their residence abroad has an immediate special right of termination for almost all local property insurance policies (household contents, liability, valuables) as of the departure date (enclose the municipality's deregistration confirmation).

4. Gym & local subscriptions

For gym subscriptions or local services, a special right of termination depends heavily on the general terms and conditions (GTC).

  • Increased travel time: Under Swiss law, a mere change of residence does not automatically grant a right of termination for the gym, unless the distance becomes unreasonable due to a cantonal or long-distance move (often from 30–50 km).
  • Goodwill & transparency: Many providers grant early contract termination upon presentation of the new residence permit, in exchange for a small processing fee.
